Terms of service

The short version. What you make with Boom.design is yours. Use it within the law and the rules below. Paid plans renew until you cancel, and when you cancel you keep your plan to the end of the period you paid for. AI makes mistakes, so check a design before you print or publish it. This summary is for convenience; the full terms below are what count.
These terms are an agreement between you and Do For Tech, Inc. ("Boom.design", "we", "us"), a company registered in California, USA. They cover the Boom.design website at boom.design, the designer and everything that comes with it (together, the "service").
By creating an account or using the service, you agree to these terms. Our privacy policy explains how we handle your personal information. If you don't agree to these terms, please don't use the service.
If you use Boom.design on behalf of a company or another organisation, you accept these terms for it and confirm that you're allowed to.
1. Who can use Boom.design
You must be at least 13 years old to use Boom.design. If you're under the age of majority where you live, you may use it only with the permission of a parent or guardian, who accepts these terms on your behalf. You may not use the service if the law forbids you to, or if we have closed an account of yours before for breaking these terms.
2. Your account
- You sign up with an email address and a password, or with your Google account. Keep your sign-in details to yourself: you're responsible for everything done under your account.
- Give us an email address you use, and keep it up to date. It's how we reach you about your account and your payments.
- An account is for one person. Don't share it with others, sell it or hand it over.
- If you think someone else has got into your account, tell us straight away at support@boom.design.
3. Your content
"Your content" is what you put into Boom.design, such as the messages you write to the assistant and the pictures you upload, and the designs you make with the service.
You own your content. We don't claim ownership of any of it.
To run the service, we need your permission to handle your content. You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process and display your content, and to pass it to the service providers that help us run Boom.design, including the AI providers named in our privacy policy. We use that licence only to provide the service to you, to keep it secure and to fix problems with it. It ends when your content is deleted from the service, apart from the copies our privacy policy says we keep for a while after.
We don't sell your content, and we don't use it to train AI models.
You're responsible for your content. You confirm that you have the rights to everything you upload or ask the assistant to use, such as photos, logos, text and the likeness of the people in them, and that neither your content nor the way you use it breaks the law or these terms.
4. Designs made with AI
Boom.design uses frontier AI models to lay out designs, write text and choose pictures from what you ask for. Keep in mind:
- Check before you use it. AI gets things wrong. It can misspell a word, get a date, a price or a phone number wrong, or write something you didn't mean. Review every design before you print, publish or send it. How you use a design is up to you, and so is the responsibility for it.
- It may not be unique. Other people can get similar results from similar requests, and a design can resemble existing work. Don't count on a generated design being original. Before you use one as a logo or a brand, check that it doesn't copy anyone else's trademark or work.
- Rights in what the AI makes. Between you and us, the designs you make are yours: we give you any rights we have in them. The law in some countries doesn't give copyright to material made by AI, so we can't promise you'll hold copyright in every part of a design.
5. Stock photos and fonts
The designer and the assistant can put stock photos from Pexels and Pixabay into your designs. These photos aren't ours. Each comes under its own provider's licence, the Pexels license or the Pixabay content license, and those licences decide how you may use it. Both allow free commercial use, within limits. For example:
- don't sell a photo on its own, unchanged, or offer it on another stock photo site;
- don't show an identifiable person in a way that's offensive, or that suggests they endorse you or your product;
- trademarks, logos, brands and artworks that appear in a photo may be protected in their own right.
We don't check photos for model or property releases, and we make no promise about them.
The fonts in the designer come from the Google Fonts collection. They're published under open licences (the SIL Open Font License, the Apache License and the Ubuntu Font Licence), which allow commercial use and embedding in the files you export.
6. Acceptable use
Don't use Boom.design to make, upload, store or share anything that:
- breaks the law, or helps someone else break it;
- infringes anyone's copyright, trademark, privacy or other rights;
- sexualises minors, or is sexual content involving anyone who hasn't consented to it;
- threatens, harasses or bullies anyone, or promotes violence or hatred against people for who they are;
- is meant to deceive, such as forged or fake documents, IDs, certificates, tickets, receipts or money, phishing pages, scams, or material that impersonates a person or organisation;
- promotes terrorism, self-harm, or the sale of illegal drugs or weapons.
And don't:
- try to get into accounts, data or systems that aren't yours, or probe or test the service's security without our written permission;
- get around the service's limits, AI credits or payments, for example by opening several free accounts;
- disrupt the service or put an unreasonable load on it, including by scraping it or reaching it with bots;
- copy, resell or rent out the service, or use it to build a competing product;
- try to extract the assistant's instructions, or push it to ignore these rules.
The AI models we use have usage rules of their own, and a request that breaks them may be refused. We may remove content that breaks these rules, and suspend or close the account behind it (see section 10).
7. Plans and AI credits
Boom.design has a Free plan and paid plans, which are currently Pro and Max, billed monthly or yearly. What each plan includes and what it costs are shown on the pricing page: its AI credits each month, and its limits, such as storage, upload size, projects, pages per project and export formats. Prices are in US dollars.
The assistant runs on AI credits. Each message uses some, depending on how much work it takes. Editing by hand, uploading and exporting use none.
- Monthly credits. Your plan gives you a set number of credits each month, counted from the day you signed up or your paid plan started. Unused monthly credits don't carry over into the next month.
- Top-ups. You can buy extra credits on any plan. Top-up credits last 12 months from the day you buy them. They're used only once the month's credits are gone, those that expire soonest first.
- Credits we give you. Credits we add to your account ourselves, as a gift or to make up for a problem, last 12 months unless we tell you otherwise when we add them.
- Running out. When your credits run out, the assistant takes no new messages until your credits renew or you add more. A message that's already under way always finishes, and if it goes past what you had left, we don't charge you for the difference.
- No cash value. Credits can't be exchanged for money, moved to another account or refunded, except where the law requires it. Unused credits end when your account is deleted.
8. Payment, renewal and cancellation
Payments are handled by Stripe. When you subscribe or buy credits, you authorise us to charge your payment method through Stripe. We never see or store your full card details.
- Renewal. A paid plan is charged in advance for each month or year, and renews automatically at the end of each period until you cancel.
- Failed payments. If a renewal payment fails, Stripe tries it again for a while. If it still can't be collected, your paid plan ends and your account moves to Free.
- Switching. You can switch plans, or move between monthly and yearly billing, from Account → Subscription. A switch applies straight away and is prorated for the rest of the period: for an upgrade, you're charged the difference then; for a downgrade, the difference is credited toward your next payments.
- Cancelling. You can cancel at any time from Account → Subscription. You keep your plan until the end of the period you've paid for, and then your account moves to Free with your projects intact.
- Refunds. Payments are non-refundable, and we don't refund the rest of a period when you cancel or switch to a smaller plan, except where the law requires it. If you think you've been charged by mistake, write to support@boom.design and we'll look into it.
- Deleting your account ends any paid plan straight away, without a refund for the rest of its period, and any unused credits are lost. If a payment is taken after you've deleted your account, we refund it.
- Price changes. We may change our prices. A new price for a paid plan applies from your first renewal after we've told you about it, and we'll tell you at least 30 days before, so you can cancel first if you wish.
- Taxes. You're responsible for any sales tax, VAT or similar tax that applies to your purchase.
9. Trash and deleting your account
- A project or an upload you delete goes to the trash for 30 days, and you can restore it until then. After that it's deleted for good, and we can't bring it back.
- You can delete your account from Account → Profile. We keep it for 30 days in case you change your mind: sign in before then to restore it. After 30 days it's erased for good, with all your projects, uploads and exports. Download anything you want to keep before you delete your account.
10. Suspension and termination
You can stop using Boom.design at any time, and delete your account as described above.
We may suspend your account, or remove content, if we reasonably believe you've broken these terms, if the law requires it, or to protect the service, its users or anyone else from harm. Where we reasonably can, we'll tell you why first and give you a chance to put things right. If we close your account because of a serious or repeated breach of these terms, we don't refund payments already made.
If we ever decide to shut Boom.design down, we'll tell you at least 30 days in advance, so you can download your designs, and refund the unused part of any paid period.
Sections 3 to 5 and 11 to 20 continue to apply after your account is closed.
11. Our service and our rights
Boom.design (the software, the website, the designer and its look, our name and our logo) belongs to us and our licensors, and is protected by law. These terms give you a personal, non-exclusive, non-transferable right to use the service as they allow, while your account is open. They don't give you any other rights in it.
We keep improving Boom.design, so the service changes: we may add, change or remove features, and change the AI models the assistant uses. If we take something significant away from a paid plan, we'll tell you in advance.
We work hard to keep Boom.design running and your data safe, but we can't promise the service will always be available or free of errors. Keep your own copies of the designs that matter to you.
12. Feedback
If you send us ideas or suggestions, we may use them freely, without owing you anything for them.
13. Other services
Boom.design works with services run by others, such as Google sign-in, Stripe checkout and the stock photo sites. Your use of those services may be governed by their own terms as well, and we're not responsible for them.
14. Copyright complaints
If you believe content on Boom.design infringes your copyright, write to support@boom.design with:
- your name, address, phone number and email address;
- the work you believe is infringed;
- where the content is on Boom.design, with a link if you have one;
- a statement that you believe in good faith that the use isn't authorised by the owner, their agent or the law;
- a statement, under penalty of perjury, that your notice is accurate and that you're the owner of the copyright or authorised to act for them;
- your physical or electronic signature.
We respond to notices that meet these requirements, and we close the accounts of people who repeatedly infringe.
15. Disclaimers
The service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We don't promise that the service will meet your needs or be uninterrupted, secure or free of errors, or that what the AI makes will be accurate, original or fit for your purpose.
16. Limitation of liability
To the fullest extent the law allows:
- we're not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from or related to the service or these terms, even if we were told they were possible; and
- our total liability for all claims arising from or related to the service or these terms is limited to the greater of the amount you paid us in the 12 months before the event that gave rise to the claim, and US$100.
Some places don't allow these exclusions or limits, so some of them may not apply to you.
17. Indemnity
To the extent the law allows, if someone brings a claim against us because of your content, or because you broke these terms or the law, you'll defend us against it and cover the losses and reasonable costs, including reasonable legal fees, that result.
18. Governing law and disputes
These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. Any dispute arising from or related to these terms or the service will be decided only by the state or federal courts located in California, and you and we both consent to their jurisdiction. Before going to court, please write to us at support@boom.design: most problems can be solved that way.
If you're a consumer and the law where you live gives you rights that can't be taken away by an agreement, such as the right to bring a claim in your local courts, nothing in these terms affects those rights.
19. Changes to these terms
We may update these terms from time to time. If a change is significant, we'll tell you by email or in the app at least 30 days before it takes effect. If you keep using Boom.design after that, you accept the new terms; if you don't want to, you can cancel your plan or delete your account before they take effect. The date at the top of this page shows when these terms last changed.
20. General
- These terms, together with our privacy policy and any terms shown to you when you buy something, are the whole agreement between you and us about the service.
- If a court finds part of these terms unenforceable, the rest still applies.
- If we don't enforce a right straight away, we haven't given it up.
- You can't transfer your rights under these terms to anyone else without our written consent. We may transfer ours as part of a merger, an acquisition or a sale of our business, and we'll tell you if we do.
- We're not responsible for delays or failures caused by events beyond our reasonable control.
- We'll contact you by email or in the app.
